The protected legal right in criminal law: current state of affairs

This research paper presents the different opinions of national and international criminal doctrinarians regarding the debate on the legal good as the legitimising basis of criminal law. In the following points, the historical evolution of the discussion as mentioned earlier, the conceptions of the criminal legal good, the national jurisprudence linked to this subject, as well as, the positions of the protection of legal goods and the reestabilisation of the validity of the norm are developed. Once each of the points in the body of the research has been developed, the discussion of the problematic points is outlined, followed by a series of conclusions, recommendations, and a brief outline of this research’s contribution and social impact.
