The authors show that, throughout history, from Antiquity to the Modern Age, the law has always valued the protection of the conceived child. In our context, this idea was officially established for the first time in comparative law with the entry into force of the Peruvian Civil Code of 1984. In this sense, this paper critically analyzes Law n.o 31935, Law that recognises the rights of the conceived child, which, instead of being an advance in the protection of such rights, is presented as nonsense for the national legal system.
